By purchasing any item online Power Scooter USA or offline by phone or in person, I, as the
buyer, acknowledge and agree that I am 18 years of age or older. I understand that the
vehicles are designed for recreational use, and if used commercially or self-upgraded, the
warranty will be void. Buyer understands and agrees that what is posted in writing on this
site are the sole descriptions and characteristics of Power scooter inc’s claims or offers on
any vehicle for sale on this site. Buyer acknowledges having read and understood the
terms and conditions of sale, vehicle list, description, technical information and features,
and by purchasing any vehicle online (this website) or offline (by phone or in person) has
been informed through the written list on this site of the characteristics of the vehicles, the
description, as well as the terms and conditions of sale and the return policy. Buyer fully
agrees that any and all issues will be handled in accordance with the binding terms and
conditions of the sales policy (found here) and the warranty policy clearly stated on the
item listing page. Power scooter inc reserves the right to refuse service or sell, cancel
orders or refund payments to anyone. Power scooter inc reserves the right to change or
remove vehicle and equipment (accessory) listings. Power scooter inc reserves the right to
change the feature lists without notice and to send the new item models without notice as
the models change. Prices, specifications and images are subject to change without
notice. Buyer acknowledges and agrees that powerscooterusa.com is not responsible for
listed features, typographical or illustrative errors. Titles (MSO) are created by the factory,
not by Power scooter inc. Power scooter inc works diligently to get all titles out as soon as
possible. On average, MSOs are shipped 4-14 days after you receive the vehicle on all
scooters, motorcycles, and street trikes. In some cases, titles may take longer to receive.
At no time will Power scooter inc be responsible for delays or the amount of time it takes
for the factory to send out MSOs.

Terms and Conditions of the Sales Agreement and Warranty Policy”, You are indicating
Your full intent and full agreement with all terms and conditions of the Agreement and

Dirt Bike, Go Kart, Motorcycle, Moped, Mini Bike, and Gas Scooter is a hazardous activity
requiring varying degrees of skill and experience. for each driver. . I, as the buyer,
understand that these activities may result in serious personal injury and property damage
and I voluntarily assume all risks associated with loss, damage or injury while driving the
vehicles advertised on our website. I, as the purchaser, am aware of the risks, dangers,
and dangers of personal injury, death, and disability inherent in the specific use of these
vehicles, as well as the inherent risks, dangers, and dangers of personal injury and
disability that are increased by drivers without experience. I, as the buyer, fully understand
that I am responsible for selecting the correct vehicle size if purchasing a unit for a child. I,
as the purchaser, agree to forever release and discharge powerscooterusa.com or its
parent company and its agents, servants, employees, officers, directors, trustees and all
other persons or entities acting on its behalf and the making of any claim, actions,
damages, liabilities, costs or expenses, and attorneys’ fees that are related to, arising out
of, or in any way connected with your participation in or use of these vehicles, use of
equipment or property supplied by powerscooterusa.com or its parent company, or your
presence on the premises, whether or not such claims, actions, damages, liabilities, costs
or expenses are caused by the negligence of the seller, manufacturer or distributor. By this
Agreement, it is my intent as the buyer to assign and waive any right to sue or exercise
any legal right to seek damages from powerscooterusa.com or its parent company and its
agents, servants, employees, officers, directors, trustees and all other persons or entities
acting on its behalf. I, as the buyer, agree to pay the notary fee of ($10) per signature if
required by my state DMV. This Agreement shall affect and bind my heirs, agents,
personal representatives, and assigns. I, as the buyer, certify that I am over 18 years of
age. I, as the buyer, have carefully read the above and acknowledge that I understand and
agree to all of the above Terms and Conditions. I have had the opportunity to ask any and
all questions relating to this Agreement and its effect. I as the buyer am aware that by
purchasing this item and sending/remitting payment for it/them, I assume all risk and waive
and release certain substantial rights I may have or possess. I, as the purchaser,
therefore, disclaim all liability and waive any rights I may have with respect to my child’s or
my child’s activities with any items purchased from powerscooterusa.com
Important Limitations on Your Rights: I, as the buyer, have carefully read the Terms and

they relate to my purchase. I, as the buyer, am aware that by purchasing this item and
sending/remitting payment for any item, I assume all risk and waive and release all legal
rights I may have or possess. me as a buyer
therefore, please disclaim all liability and waive any legal rights you may have in and with
any items purchased from Power scooter inc. Any and all issues or problems will be
resolved in accordance with the terms of the agreement and warranty policy specified in
this binding contract. By purchasing a product from Power scooter inc, once the order has
been shipped, you agree that you waive your right to any chargeback to your credit card or
PayPal account under any circumstances (except if you do not receive the order). and will
handle any and all issues in accordance with our terms and conditions policy and warranty
policy.

You (by purchasing from Power scooter inc) agree that Florida law (without regard to its
conflict of laws principles) will govern this Agreement, that any disputes arising out of or
related to this Agreement will be subject to the exclusive jurisdiction of federal and state
courts. in the State of Florida at the sole option of Power scooter inc, and that you submit
to the exclusive jurisdiction of the federal and state courts in the State of Florida a. The
failure of Power scooter inc to exercise or enforce any right or provision of this agreement
shall not constitute a waiver of such right or provision. The failure of Power scooter inc or
you to exercise in any respect any rights hereunder shall not be deemed a waiver of any
other rights hereunder. This Agreement, accepted by You, at the time of your purchase
from Power scooter inc, contains the entire agreement between you and Power scooter
inc. If any provision of this Agreement is held invalid, the remainder of this Agreement will
continue in full force and effect.
